These Terms & Conditions apply to all retreats, coworking programs, travel experiences, wellness activities, accommodation arrangements, excursions, meals, workshops, and related services offered by Work Well SpA, operating under the brand name Work Well Retreats.

By submitting an application, reserving a spot, paying a deposit, making a payment, or otherwise participating in a Work Well Retreats program, you agree to these Terms & Conditions.

These Terms should be read together with the retreat description, booking confirmation, invoice, payment terms, privacy policy, waiver, and any written information we provide before your retreat.


1. Our Agreement

Your agreement is with Work Well SpA, RUT 78.413.449-0, operating as Work Well Retreats.

The person named in the booking form is the “Participant,” “you,” or “your.” You confirm that you are at least 18 years old and have legal capacity to enter into this agreement.

Your booking becomes confirmed only when:

  1. Work Well Retreats accepts your booking or application in writing; and
  2. Work Well Retreats receives your required deposit or payment.

Until both steps are complete, your place is not guaranteed.


2. Definitions

Work Well Retreats, Work Well, we, us, or our means Work Well SpA, RUT 78.413.449-0.

Retreat means the Work Well Retreats program you have booked, including the dates, destination, accommodation type, coworking schedule, meals, activities, and other inclusions confirmed in writing.

Retreat Fee means the total price payable for your Retreat.

Deposit means the non-refundable US$500 payment required to reserve your spot.

Balance means the remaining amount due after your Deposit.

Retreat Start Date means the first scheduled day of the Retreat.

Accommodation Provider means the hotel, lodge, villa, apartment, retreat property, or other third-party accommodation used during the Retreat.

Activity Provider means any third-party provider of excursions, transport, movement classes, wellness sessions, guides, meals, cultural activities, or other experiences.

Force Majeure means events outside our reasonable control, including natural disasters, extreme weather, fire, flood, volcanic activity, earthquake, illness outbreaks, epidemics, pandemics, strikes, civil unrest, travel restrictions, government action, transport disruption, supplier failure due to events outside our control, or other unavoidable and extraordinary circumstances.


3. What Is Included

Each Retreat may include some or all of the following, depending on the specific Retreat you book:

  • Accommodation for the dates stated in your booking confirmation.
  • Access to coworking space or designated work areas.
  • WiFi, subject to local infrastructure and provider limitations.
  • Structured deep work blocks.
  • Morning movement or wellness sessions.
  • Group meals, where listed as included.
  • Community activities, workshops, Spanish classes, wine tastings, cultural experiences, or excursions, where listed as included.
  • On-site or destination support from Work Well Retreats or our local partners.

The exact inclusions for your Retreat will be listed on the relevant Retreat page, proposal, invoice, or booking confirmation.

Anything not expressly listed as included is excluded.


4. What Is Not Included

Unless specifically stated in writing, the Retreat Fee does not include:

  • International or domestic flights.
  • Airport transfers, unless expressly included.
  • Visas, tourist cards, entry requirements, vaccines, or travel documents.
  • Travel insurance, health insurance, medical expenses, or evacuation coverage.
  • Additional meals, snacks, drinks, alcohol, or minibar charges.
  • Personal expenses.
  • Laundry, spa treatments, massages, equipment rentals, or optional activities.
  • Coworking equipment such as laptops, monitors, adapters, headphones, chargers, or office supplies.
  • Additional accommodation before or after the Retreat.
  • Taxes, bank fees, credit card fees, wire fees, or foreign exchange costs, unless included in the quoted price.

5. Remote Work Disclaimer

Work Well Retreats is designed to support remote professionals while they travel. However, we do not guarantee that your employer, client, or business will allow you to work from Chile or from the Retreat destination.

You are solely responsible for:

  • Confirming that you may legally and contractually work remotely from the Retreat location.
  • Complying with your employer’s policies.
  • Managing your work schedule, deliverables, meetings, and performance.
  • Bringing all equipment needed for your work.
  • Confirming whether your work creates immigration, tax, employment, licensing, confidentiality, data protection, or cybersecurity obligations.

Work Well Retreats is not responsible for any employment, client, tax, immigration, or business consequences arising from your decision to participate in a Retreat.


6. WiFi and Work Environment

Work Well Retreats makes reasonable efforts to select locations with reliable WiFi suitable for remote work and video calls. However, WiFi and connectivity in travel destinations may be affected by local infrastructure, weather, power outages, telecom provider issues, location-specific limitations, or events outside our control.

You acknowledge that:

  • WiFi speed and reliability cannot be guaranteed at all times.
  • Backup connectivity, such as a mobile hotspot or local SIM/eSIM, is your responsibility.
  • Work Well Retreats is not liable for missed meetings, lost income, client issues, employer issues, business disruption, or other consequences caused by internet outages or connectivity limitations.

7. Accommodation

Where accommodation is included, Work Well Retreats will provide accommodation for the Retreat dates and room type confirmed in writing.

Room types may include private rooms, shared rooms, twin rooms, double rooms, cabins, apartments, lodges, or other arrangements depending on the Retreat.

You agree to follow all accommodation rules, including check-in and check-out times, quiet hours, guest policies, smoking rules, pet policies, damage policies, and safety requirements.

You may be required to provide a credit card, security deposit, or identification directly to the Accommodation Provider at check-in.

You are responsible for any damage, missing items, additional cleaning fees, late checkout fees, or incidental charges caused by you.

Unauthorized guests are not permitted in Retreat accommodation unless approved in writing by Work Well Retreats and the Accommodation Provider.


8. Payments

To reserve your spot, you must pay a US$500 non-refundable deposit.

Your booking is not confirmed until Work Well Retreats has accepted your booking in writing and received your deposit.

Unless otherwise stated in writing:

  • The US$500 deposit is non-refundable.
  • The remaining balance is due 30 days before the Retreat Start Date.
  • If the balance is not paid by the due date, Work Well Retreats may treat your booking as cancelled by you.
  • If your booking is cancelled for non-payment, the cancellation policy below will apply.
  • You are responsible for any bank fees, transfer fees, credit card fees, currency conversion costs, or payment processing charges.

9. Pricing and Currency

Prices may be listed in USD, CLP, or another currency. The currency applicable to your booking will be stated in your invoice or booking confirmation.

If payments are made in a currency different from the quoted price, exchange rates, bank fees, and transfer fees are your responsibility.

Prices are subject to change until your booking is confirmed. Once your booking is confirmed, your Retreat Fee will not change unless you request changes, add-ons, upgrades, additional nights, private transfers, or optional activities.


10. Discounts and Promotions

Discounts, referral credits, promotional rates, or early-bird pricing may be offered from time to time.

Unless expressly stated:

  • Discounts cannot be combined.
  • Discounts have no cash value.
  • Referral credits apply only after the referred participant has paid in full.
  • Promotions may be withdrawn at any time before a booking is confirmed.

11. Cancellation by You

All cancellation requests must be submitted in writing by email.

Unless your booking confirmation states otherwise, the following cancellation policy applies:

More than 60 days before the Retreat Start Date

Your US$500 deposit is non-refundable.

Any additional amounts paid may be refunded, less any non-recoverable costs already incurred by Work Well Retreats, including accommodation, supplier, transfer, activity, administrative, or payment processing costs.

60 days or fewer before the Retreat Start Date

All amounts paid are non-refundable.

30 days or fewer before the Retreat Start Date

Your full balance is due. If you cancel after the final payment deadline, all amounts paid are non-refundable.

After the Retreat begins

No refunds or credits will be provided for late arrival, early departure, unused accommodation, missed meals, missed activities, illness, work conflicts, travel delays, weather, personal circumstances, or choosing not to participate in any part of the Retreat.

Work Well Retreats strongly recommends purchasing travel insurance immediately after booking, including coverage for trip cancellation and interruption.


12. Right of Withdrawal / Derecho a Retracto

Work Well Retreats provides fixed-date travel, accommodation, coworking, wellness, and experience-based services that require advance reservations with hotels, transport providers, guides, restaurants, instructors, and other third-party suppliers.

To the fullest extent permitted by applicable law, Work Well Retreats excludes the right of withdrawal / derecho a retracto for Retreat bookings.

This exclusion will be clearly disclosed before payment and in the written booking confirmation. By paying your deposit or Retreat Fee, you acknowledge and accept that the right of withdrawal is excluded, except where mandatory law provides otherwise.

Nothing in this section limits any mandatory consumer rights that cannot legally be waived.


13. Changes Requested by You

Requests to change your Retreat dates, destination, room type, or participant name are subject to availability and supplier approval.

Work Well Retreats may charge:

  • Any difference in Retreat Fee.
  • Supplier fees or penalties.
  • Administrative fees.
  • Additional accommodation, transport, or activity costs.

We cannot guarantee that requested changes will be possible.


14. Substituting Another Participant

You may request to transfer your place to another eligible participant. Transfers are subject to approval by Work Well Retreats and any relevant suppliers.

The replacement participant must:

  • Complete all required forms.
  • Accept these Terms & Conditions.
  • Meet any Retreat participation requirements.
  • Pay any outstanding balance or transfer fees.

Work Well Retreats may refuse a transfer request if it is not practical, if suppliers do not approve it, or if the replacement participant is not suitable for the Retreat.


15. Cancellation or Changes by Work Well Retreats

Work Well Retreats may make reasonable changes to a Retreat when necessary, including changes to accommodation, activity providers, schedule, meal venues, coworking setup, transport, or specific inclusions.

We will make reasonable efforts to provide a comparable alternative where possible.

Work Well Retreats may cancel a Retreat if:

  • The minimum number of participants is not reached.
  • A supplier cancels or materially changes an essential part of the Retreat.
  • Force Majeure affects the Retreat.
  • Safety, operational, legal, or health concerns make the Retreat impractical or unsafe.
  • You fail to pay the Balance when due.
  • You breach these Terms.

If Work Well Retreats cancels the Retreat for reasons within our control before the Retreat Start Date, we will offer one of the following:

  1. A transfer to another Retreat;
  2. A credit for a future Retreat; or
  3. A refund of amounts paid to Work Well Retreats, less any non-refundable costs already incurred where permitted by law.

Work Well Retreats is not responsible for flights, visas, insurance, equipment purchases, lost income, or other expenses you incur in connection with the Retreat.


16. Minimum Numbers

Some Retreats require a minimum number of participants.

If minimum numbers are not reached, Work Well Retreats may cancel or modify the Retreat. In that case, we will notify you as soon as reasonably possible and offer a transfer, credit, or refund according to Section 15.

You should not book non-refundable flights or other arrangements until Work Well Retreats confirms that the Retreat is guaranteed to run.


17. Travel Documents, Visas, and Entry Requirements

You are responsible for ensuring that you have:

  • A valid passport.
  • Any required visa, tourist card, permit, vaccination certificate, or entry document.
  • Proof of onward travel, if required.
  • Any documents required by airlines, border authorities, or local authorities.

Work Well Retreats is not responsible if you are denied boarding, denied entry, delayed, fined, quarantined, or otherwise unable to attend the Retreat due to travel document issues.


18. Travel Insurance

Travel insurance is mandatory for every participant.

Each participant is responsible for purchasing their own travel insurance policy. Work Well Retreats does not provide travel insurance and is not responsible for arranging coverage on your behalf.

Your travel insurance should cover, at minimum:

  • Trip cancellation and interruption.
  • Medical care while traveling.
  • Emergency evacuation and repatriation.
  • Accidents and personal injury.
  • Lost, stolen, or damaged belongings.
  • Travel delays or missed connections.
  • Adventure, outdoor, or wellness activities, where applicable.
  • Laptops, phones, and work equipment, where applicable.

You are responsible for confirming that your policy covers the specific destination, dates, activities, and circumstances of your Retreat.

Work Well Retreats may request proof of travel insurance before the Retreat begins. If you do not obtain adequate travel insurance, Work Well Retreats may refuse your participation, and no refund will be provided.


19. Health, Fitness, and Medical Conditions

You are responsible for ensuring that you are physically and mentally fit to participate in the Retreat and any activities you choose to join.

You must tell Work Well Retreats in writing before the Retreat if you have any medical condition, allergy, dietary restriction, disability, mobility limitation, mental health condition, medication requirement, or other circumstance that may affect your participation.

Work Well Retreats will make reasonable efforts to accommodate disclosed needs, but we cannot guarantee that all Retreats, accommodations, meals, or activities will be suitable for every participant.

You are responsible for bringing necessary medications, medical devices, prescriptions, and insurance documents.

In an emergency, you authorize Work Well Retreats, its representatives, or its suppliers to seek medical assistance on your behalf. You remain responsible for all medical costs, transport, evacuation, and related expenses.


20. Meals, Dietary Requirements, and Allergies

Work Well Retreats will make reasonable efforts to accommodate dietary preferences and allergies disclosed in advance.

However, meals may be prepared by third-party restaurants, hotels, cooks, or suppliers. Work Well Retreats cannot guarantee an allergen-free environment.

You are responsible for deciding whether any food or beverage is safe for you to consume.


21. Activities and Excursions

Retreat activities may include movement classes, hikes, outdoor excursions, cultural visits, wine tastings, Spanish classes, group meals, workshops, or other experiences.

Some activities involve inherent risks, including injury, illness, weather exposure, altitude, uneven terrain, transport risks, water risks, animals, food or alcohol consumption, or other hazards.

Participation in activities is voluntary. You are responsible for assessing your own ability and comfort level before participating.

Work Well Retreats may cancel, modify, or replace activities due to weather, safety, supplier availability, participant ability, or other operational reasons.


22. Alcohol and Substance Use

Some Retreats may include meals, wine tastings, or social events where alcohol is available.

You are responsible for your own alcohol consumption and behavior.

Excessive drinking, illegal drug use, unsafe conduct, harassment, or behavior that affects the safety or enjoyment of others may result in removal from the Retreat without refund.

Illegal substances are not permitted.


23. Participant Conduct

You agree to behave respectfully toward other participants, hosts, staff, suppliers, local communities, and property.

Work Well Retreats may remove you from the Retreat without refund if, in our reasonable opinion, you:

  • Harass, bully, threaten, or discriminate against others.
  • Act in a dangerous, abusive, disruptive, or antisocial manner.
  • Damage property.
  • Break local laws.
  • Violate accommodation or supplier rules.
  • Put yourself or others at risk.
  • Fail to follow reasonable safety instructions.
  • Repeatedly disrupt the work environment or group experience.

If you are removed from a Retreat, you are responsible for your own onward travel, accommodation, and costs.


24. Personal Belongings and Work Equipment

You are responsible for your personal belongings, valuables, passport, travel documents, laptop, phone, work equipment, and money at all times.

Work Well Retreats is not responsible for loss, theft, or damage to your belongings unless caused directly by our proven negligence.

We recommend that you keep valuables secure and ensure your insurance covers laptops, devices, and work equipment.


25. Damage to Property

You are responsible for any damage, loss, additional cleaning, fines, penalties, or charges caused by you to accommodation, coworking spaces, transport, equipment, restaurants, activity providers, or other property.

You agree to reimburse Work Well Retreats, the Accommodation Provider, or the relevant supplier for such costs within 14 days of request.


26. Complaints and Problems During the Retreat

If you experience a problem during the Retreat, you must notify Work Well Retreats as soon as possible so we have an opportunity to help resolve it.

Complaints should be made in writing by email or WhatsApp with clear details of the issue.

If you do not notify us during the Retreat, we may not be able to remedy the issue and may not be responsible for compensation or refunds.


27. Third-Party Suppliers

Work Well Retreats may arrange services provided by third parties, including accommodation, transport, restaurants, guides, instructors, activity providers, coworking spaces, and wellness professionals.

We use reasonable care in selecting suppliers, but we do not control every aspect of their operations.

You agree to follow each supplier’s rules, safety instructions, and policies.

Subject to mandatory consumer protection laws, Work Well Retreats is not responsible for acts, omissions, delays, cancellations, injuries, losses, or damages caused by third-party suppliers outside our reasonable control.


28. Limitation of Liability

Work Well Retreats will provide the Retreat with reasonable skill and care.

Subject to applicable law, Work Well Retreats is not liable for:

  • Your acts or omissions.
  • The acts or omissions of third parties not under our control.
  • Force Majeure.
  • Travel delays, flight cancellations, or transport issues.
  • Lost income, missed meetings, employer issues, client issues, or business losses.
  • Loss or damage to personal belongings.
  • Illness, injury, or medical expenses not caused by our negligence.
  • Optional activities or services not included in your confirmed booking.
  • Services you book independently.

Where liability cannot be excluded by law, Work Well Retreats’ liability will be limited to the amount you paid to Work Well Retreats for the Retreat, except where a different limitation is required by applicable law.

Nothing in these Terms limits liability where it would be unlawful to do so.


29. Force Majeure

Work Well Retreats is not responsible for failure or delay in performing our obligations where caused by Force Majeure.

If Force Majeure affects a Retreat, Work Well Retreats may cancel, postpone, modify, relocate, or shorten the Retreat.

Where possible, Work Well Retreats will try to recover refunds or credits from suppliers and pass them on to participants, but we cannot guarantee recovery of supplier payments.

Work Well Retreats is not responsible for additional travel, accommodation, flight, insurance, work, or personal costs caused by Force Majeure.


30. Photography, Video, and Marketing

Photos and videos may be taken during the Retreat for use on our website, social media, email, advertising, and promotional materials.

By participating, you consent to being photographed or filmed in group settings unless you tell us in writing before the Retreat that you do not want to be included.

Work Well Retreats will make reasonable efforts not to use close-up or individually identifiable images of you for marketing if you have opted out.

You may not use photos or videos of other participants for commercial purposes without their consent.


31. Privacy and Personal Data

Work Well Retreats collects and processes personal information needed to manage your booking, operate the Retreat, communicate with you, coordinate suppliers, comply with legal requirements, and provide services.

This may include your name, contact details, passport or travel information where required, dietary needs, health disclosures, emergency contact, payment details, and booking preferences.

Work Well Retreats may share necessary information with accommodation providers, activity providers, transport providers, payment processors, insurers, legal advisors, or other suppliers as needed to provide the Retreat.

Our privacy practices are described in our Privacy Policy.


32. Confidentiality and Professional Conduct

Because Retreat participants may be working remotely during the program, you agree to respect the confidentiality of other participants’ work, calls, documents, conversations, screens, and business information.

You agree not to record, photograph, share, or disclose another participant’s confidential work information without permission.

You are responsible for protecting your own employer, client, or business confidentiality obligations while participating in the Retreat.


33. Website and Promotional Materials

Work Well Retreats makes reasonable efforts to ensure that information on our website and promotional materials is accurate.

However, photos, descriptions, schedules, activities, and sample itineraries are illustrative and may vary depending on destination, season, weather, supplier availability, and operational needs.

Work Well Retreats will honor the specific inclusions confirmed in your booking confirmation, subject to these Terms.


34. Website Terms of Use

The content on the Work Well Retreats website is provided for general information and marketing purposes.

You may not copy, reproduce, distribute, modify, or use our website content, images, branding, logo, retreat materials, guides, itineraries, or other intellectual property for commercial purposes without written permission from Work Well Retreats.

Third-party links may be provided for convenience. Work Well Retreats is not responsible for third-party websites or their content.


35. Governing Law and Disputes

These Terms are governed by the laws of Chile, subject to any mandatory consumer protection laws that apply to you.

The parties will first try to resolve any dispute in good faith by written communication.

If the dispute cannot be resolved informally, it will be submitted to the competent courts or dispute resolution authority of Santiago, Chile, unless mandatory consumer law requires another forum.


36. Changes to These Terms

Work Well Retreats may update these Terms from time to time.

The Terms that apply to your booking are the Terms in effect when your booking is confirmed, unless changes are required by law or agreed in writing.


37. Severability

If any part of these Terms is found to be invalid, illegal, or unenforceable, the remaining parts will continue to apply.


38. Entire Agreement

These Terms, together with your booking confirmation, invoice, Retreat description, waiver, privacy policy, and any written terms we provide, form the entire agreement between you and Work Well Retreats.

In the event of conflict, the specific written terms in your booking confirmation will prevail over general website descriptions.
